OVERVIEW
Welcome to MATCHASHOP! The terms "we", "us" and "our" refer to Matchashop B.V. MATCHASHOP operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). MATCHASHOP is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you have the consent of a parent or legal guardian. You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.
To use the Services, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services. However, colours or product appearance may differ from how they appear on your screen due to your device type and settings. We do not warrant that the quality of any products purchased will meet your expectations or be exactly as depicted on our website.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region or jurisdiction.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. MATCHASHOP reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until MATCHASHOP confirms acceptance via order confirmation email. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel your order, we will notify you via the contact details provided at checkout.
Your purchases are subject to our Return Policy.
SECTION 4 - PRICES AND BILLING
All prices displayed on our website are inclusive of VAT, in accordance with applicable EU and Dutch consumer law. Prices are exclusive of shipping costs, which are calculated and clearly displayed at checkout before you complete your purchase.
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as confirmed in your order confirmation email.
You agree to provide current, complete and accurate payment information for all purchases. You agree to promptly update your account information, including email address and payment details, so that we can complete your transactions and contact you as needed.
SECTION 5 - RIGHT OF WITHDRAWAL AND RETURNS
As a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason. To exercise this right, you must notify us within this period by contacting us at info@matchashop.com.
Please note that the right of withdrawal does not apply to:
- Opened food products, for health and hygiene reasons
- Custom or personalised products
- Sale items and gift cards
After notifying us of your intention to return, you have 14 days to send the item back. Return shipping costs are at your expense. Upon receipt and inspection of your return, we will process your refund to your original payment method within 10 business days. Original shipping costs are non-refundable unless the return is the result of our error or a defective product.

SECTION 6 - CONFORMITY AND LEGAL GUARANTEE
Under Dutch and EU consumer law, all products must conform to the purchase agreement. If a product is defective, damaged, or not as described, you are entitled to a repair, replacement, or refund. Please contact us at info@matchashop.com within a reasonable time of discovering the defect. This legal guarantee is in addition to, and does not affect, any other rights you may have as a consumer.
SECTION 7 - SHIPPING AND DELIVERY
We ship within Europe. Shipping availability for specific countries is confirmed at checkout. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer your order to the carrier, risk of loss passes to you.

SECTION 8 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, images, graphics, product content, video and audio, and the design, selection and arrangement thereof, are owned by MATCHASHOP, its affiliates or licensors and are protected by Dutch and international copyright and intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from our Services without our prior written consent. All rights not expressly granted herein are reserved by MATCHASHOP.
MATCHASHOP's names, logos, product and service names, designs and slogans are trademarks of MATCHASHOP or its affiliates or licensors. You must not use such marks without our prior written permission. Shopify's name, logo and related marks are trademarks of Shopify Inc.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
MATCHASHOP is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with MATCHASHOP. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MATCHASHOP, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with MATCHASHOP.
SECTION 10 - OPTIONAL TOOLS AND THIRD-PARTY LINKS
We may provide access to third-party tools and links to external websites as part of the Services. We do not monitor or control these tools or websites and are not responsible for their content, accuracy or practices. Access to third-party tools and websites is entirely at your own risk. Complaints or questions regarding third-party products or services should be directed to the relevant third party.

SECTION 12 - FEEDBACK
If you submit ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and distribute such Feedback for any purpose, including commercial use. You represent that you own or have the right to submit all Feedback and that it does not violate any third-party rights. We are under no obligation to maintain Feedback in confidence, pay compensation for it, or respond to it.

Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges or availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including after you have submitted your order.

- Infringe our intellectual property rights or those of any third party

We reserve the right to suspend or terminate your account at any time if we determine you have violated these Terms.
SECTION 15 - AGENTS
15.1 This section applies if you use, allow, enable or deploy an automated agent ("Agent") to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct supervision.
15.2 No Agent may access or interact with the Services unless it identifies itself and operates in accordance with the requirements in section 15.4 below. No Agent may access the Services if we have requested it to refrain from doing so.
15.3 We may limit, including by technical means, whether and how any Agent accesses or interacts with the Services.
15.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not conceal that interactions are from an Agent, including by mimicking human behaviour or bypassing CAPTCHAs; (iii) respond truthfully when asked whether interactions are from a human or a computer; (iv) not circumvent any measure intended to block or control Agent access.
SECTION 16 - TERMINATION
We may terminate this agreement or your access to the Services at any time without notice, at our sole discretion. You will remain liable for all amounts due up to and including the date of termination. The following sections survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Privacy and any provisions that by their nature should survive.
SECTION 17 - DISCLAIMER OF WARRANTIES
The Services and all products offered through the Services are provided "as is" and "as available" without any warranties or conditions of any kind, either express or implied, to the fullest extent permitted by applicable law. We do not guarantee that the Services will be uninterrupted, secure or error-free.
Nothing in this section affects your statutory rights as a consumer under Dutch or EU law, which cannot be excluded or limited by contract.
SECTION 18 - LIMITATION OF LIABILITY
To the fullest extent permitted by Dutch and EU law, our total liability to you in connection with any order shall not exceed the amount paid by you for that order. We are not liable for any indirect, incidental, punitive or consequential damages, including lost profits or data.
This limitation does not apply to liability arising from intent or gross negligence, or to any statutory rights you hold as a consumer that cannot be waived by contract.
SECTION 19 - INDEMNIFICATION
You agree to indemnify and hold harmless MATCHASHOP, Shopify, and our affiliates, officers, directors, employees, agents and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your use of the Services.
SECTION 20 - COMPLAINTS AND DISPUTE RESOLUTION
If you have a complaint, please contact us first at info@matchashop.com. We aim to respond to all complaints within 5 business days and will do our best to resolve any issues promptly and fairly.
If we are unable to resolve your complaint, you have the right to submit it to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
SECTION 21 - GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these Terms or your use of the Services shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands, unless mandatory consumer law in your country of residence provides otherwise.
SECTION 22 - SEVERABILITY AND WAIVER
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
SECTION 23 - ENTIRE AGREEMENT AND ASSIGNMENT
These Terms, together with our Privacy Policy, Return Policy and Shipping Policy, constitute the entire agreement between you and MATCHASHOP regarding your use of the Services. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice to you.
SECTION 24 - CHANGES TO TERMS OF SERVICE
We reserve the right to update or replace these Terms at any time. Material changes will be communicated at least 30 days in advance via email or a notice on our website. The most current version of these Terms is always available on this page. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
